By booking a photography session with Copper Nickel Memories, the client automatically agrees to the following terms and conditions.

Booking, Deposits, and Payments
- Creative Deposit. A non-refundable creative deposit — a fixed dollar amount, not a percentage — is required to reserve the date and time of your session. This deposit is strictly non-refundable upon proceeding with the session.
- Payment Schedule. The remaining balance is due in full by 5:00 PM, 2 days prior to the scheduled session. Failure to pay any remaining balance by this deadline may result in the cancellation or rescheduling of the session.
- Session Fee Scope. The session fee covers the photography experience itself, including creative direction, posing instruction, a pre-session consultation, and the use of the studio. The session fee does not include digital or physical products, which must be purchased separately after the session.
- On-Location Fees. Any fees or permits required for on-location shoots are the sole responsibility of the client.

Cancellations, Rescheduling, and Late Arrivals
- Cancellations. If the client cancels the session in writing at least one week prior to the scheduled date, any amounts paid beyond the non-refundable creative deposit will be refunded.
- Rescheduling. Session type and schedule changes are allowed until 24 hours before the session, and must be requested through the studio. This is not a self-serve last-minute swap. The creative deposit is transferable when a standard session is rescheduled at least 24 hours in advance. For event photography, requests to reschedule must be made at least two weeks in advance to transfer the deposit.
- Late Arrivals. Sessions begin promptly at the scheduled time, regardless of the client's arrival time. Arriving late will reduce the available shooting time and will not result in an extension of the session. If a client is more than 20 minutes late, the photographer reserves the right to cancel the session and classify the client as a "no-show".
- No-Shows. Clients who fail to arrive for their session without prior notice will forfeit their creative deposit and any additional amounts paid.

The Reveal, Turnaround Times, and Orders
- Image Reveal. A 45-minute in-person reveal appointment may be requested when you book your session. Proofs will be provided at the reveal. Clients will select their packages and physical products during this appointment. The studio confirms reveal timing.
- Turnaround Times. Standard turnaround time is 7 days for sessions and 14 to 21 days for events. Rush editing services are available for an additional fee.
- Digital Galleries. A watermarked digital gallery will be made available after the Reveal Appointment and will remain active for 6 months. Unselected images are not guaranteed to be retained after the selection process. Digital downloads and ordered products will only be released once payment is received in full.
- Refunds and Orders. There are strictly no refunds or reshoots allowed once digital files have been downloaded. Physical orders are non-refundable once they have been submitted to the print lab.
- Client Responsibility. The client is responsible for reviewing their selections carefully. Copper Nickel Memories is not liable for color variations between digital screens and physical prints. Product defects will be handled strictly according to the fulfilling lab or vendor's policies. The client is entirely responsible for downloading and providing safe, long-term storage for their digital images.

Editing, Creative License, and Copyright
- Copyright Ownership. Full copyright of all images remains exclusively with Copper Nickel Memories. Clients receive a license and print release only for the specific images they purchase. Clients may not sell the images.
- Creative License. The photographer reserves all creative rights to the editing process and will only release images deemed to be of professional quality. The client acknowledges familiarity with the photographer's artistic style, aesthetic, composition, and posing techniques.
- Editing Scope. Professional image enhancement includes standard color correction, exposure adjustments, cropping, and minor blemish removal. It does not include extensive retouching, body modifications, major skin alterations, background manipulation, or head-swaps.
- Prohibited Alterations. Any edits, filters, AI alterations, watermark removals, or other modifications performed by anyone other than the photographer are strictly prohibited and constitute copyright infringement.
- Social Media. Clients are encouraged to share their purchased images on social media, provided the images remain completely unaltered and the photographer is properly tagged or credited.

Client Conduct and Minors
- Conduct. All clients and guests are expected to conduct themselves in a respectful and appropriate manner. The photographer reserves the right to pause, refuse, or terminate a session immediately if a client or guest engages in behavior that is threatening, abusive, harassing, discriminatory, sexually inappropriate, excessively disruptive, or unsafe.
- Minors. Consent from a parent or legal guardian is required to photograph minors. Parents or guardians are entirely responsible for supervising children and ensuring their safety during the session; the photographer assumes no responsibility for child supervision.

Failure to Perform and Force Majeure
- Technological Issues. If the photographer is unable to deliver the photographic materials due to a technological malfunction, Copper Nickel Memories is only liable for a refund of the amount paid by the client and is not liable for any other assumed losses or damages.
- Illness or Injury. In the event the photographer becomes injured or too ill to perform, reasonable efforts will be made to secure a suitable replacement photographer. If a replacement cannot be found and the client chooses not to reschedule, Copper Nickel Memories will return the final payment.
- Weather and External Factors. The photographer is not responsible for weather restrictions or conditions that impact the session. If a session cannot take place due to reasons beyond the photographer's control (Force Majeure) and cannot be reasonably rescheduled, Copper Nickel Memories will return the final payment.

Liability and Indemnification
- Liability Release. Copper Nickel Memories is not liable for any personal injury, property damage, or lost/damaged personal items that occur during the session. The client assumes responsibility for themselves, their children, their pets, and any location hazards.
- Indemnification. The client agrees to indemnify and hold harmless Copper Nickel Memories against any claims resulting from the client's failure to disclose relevant circumstances or hazards prior to the session.

Dispute Resolution and Agreement Terms
- Dispute Resolution. Any disputes arising from this agreement will be resolved through standard legal mediation or arbitration within the State of Utah prior to further legal action.
- Entire Agreement. This document constitutes the entire agreement between the client and Copper Nickel Memories, superseding any prior verbal or written agreements.
- Electronic Signatures. Acknowledgment of these terms via an online booking portal or electronic signature carries the same legal weight as a physical signature.
